Assisted Living Facilities Requirements in Maine

In the state of Maine, there are 4 levels of senior residential care facilities. They are grouped into Assisted Housing Programs, Assisted Living Programs, Level 1-4 Residential Care facilities and Private Institutions that are not medical.

The governmental agency that oversees the licensures of assisted living and residential care facilities in Maine is the Department of Health and Human Services, The Division of Licensing and Regulatory Services. Residential Care Facilities and Private Care Institutions are licensed separately due to the funding from Medicaid that they receive. They have to follow even more stringent regulations than other types of senior living facilities in Maine.

For the state of Maine, there are no special physical requirements for assisted living units. However, for the residential care facilities, there are certain requirements. They simply state that that requirements should be able to meet the needs of the population of which they serve. The floor space of each assisted living unit in Maine must be 100 square feet and 80 square feet for double occupancy, not including non-living spaces such as bathrooms, closets and door swing.

Bathroom requirements for assisted living facilities are that there must be one toilet per 6 residents. Sharing toilets is permissible under the above standards. One full bathroom with complete bathtub or shower may be shared between every 15 residents.
