In South Dakota, assisted living facilities are legally referred to as Assisted Living Centers. They are licensed by the Department of Health for South Dakota through the office of Health Care Facilities. This license only covers basic, limited personal care. On January 9, 2012, the Department of Health made a revision to the licensing rules separating assisted living from the regulations for medical facilities.

At most, 2 residents can share one assisted living unit in South Dakota. If there is new construction, then a toilet room must not be shared between resident rooms. In old construction, bathrooms may serve 2 rooms but there is a 4-bed maximum. For older structures, a toilet room will be provided without the resident having to go through the main corridor.
